This Privacy Policy (this “Policy”) describes how Advanced Microbial Solutions, L.L.C. d/b/a Agricen, our affiliates, and those in the Agricen family companies (“Agricen,” “we,” or “us”) collects, uses, and discloses personal information through our websites, including www.agricen.com, www.agricensciences.com, and their subdomains (“Websites”), and through our interactions by email, telephone, or other means (collectively, the “Services”). As used in this Policy, “personal information” means information that relates to an identified or reasonably identifiable natural person.

Residents of California, Nebraska, Nevada, and Texas should refer to the body of this Policy as well as the “Privacy Rights” and the “Supplemental Privacy Notice for California Residents” sections below, as applicable, for additional information that may be applicable to them.

Personal Information We Collect

We collect and process personal information for our internal and Services-related purposes, and in order to provide, improve, and enhance our Services.

Contact or request submissions. When you use a contact or request form on the Websites, we collect personal information from you to evaluate and respond to your request, and we may also use the information to improve our Services. The information you provide may include your contact information such as name, mailing address, e-mail address, and phone number, and any other information you choose to include when you communicate with us via e-mail, mail, phone, or other channels.

Email and blog subscriptions and webinar sign ups. When you subscribe to receive email messages from us, subscribe to our blog, or sign up for our webinars or other services, we collect your contact information, such as your name and e-mail address, and your subscription preferences.

Communications. We receive information you submit through your communications with us by email, phone, or physical mail or courier service, and we process this information to respond to you and in the normal course of our business operations.

Business contact information. This includes information you provide when you contact us in connection with commercial accounts, including business name, telephone number, email address, and the name of the business representative. We may receive such information through our online or offline interactions with you, such as when we work together on a project, when you or your company provides services to us, or when we discuss opportunities to work together. We may send you emails or call you with information about our business dealings, news, or marketing information to communicate with you for business purposes.

Social media. We collect may personal information when you use our social media sites or you post information on our webpage on a social media platform. We may use this information to respond, to promote our services, and in the normal course of our operations. We may collect your personal identifiers, such as your social media username, and other personal characteristics that you have made publicly available on the social media website. Note that the third-party operators of social media websites also receive such information, and their use of your personal information is governed by their own privacy policies.

Information collected from third parties about you. We collect information about your interests, contact information, demographic information, and marketing inferences, from third party sources that provide consumer data, social networks, and other sources of publicly available data. We may also collect information about the marketing and advertisements you have seen or clicked on, from online advertising companies.

If you provide us with personal information regarding another individual, you represent that you have that person’s consent to give us their information and to permit us to use the information in accordance with this Policy.

Automated Data Collection; Cookies and Similar Technologies. When you visit our Websites, subscribe to or open an email, we and our vendors and third-party partners, such as advertising partners and analytics providers (including Google Analytics), collect information by automated means.

We may use cookies and similar technologies to collect your IP address, information about your device (such as your browser characteristics, device IDs and characteristics, and operating system version) and information concerning your usage of our Services (including the link you used to reach a given webpage). We use this information to determine how many users have visited particular webpages, viewed particular content, or opened messages or alerts, and we may also use such information to improve the performance of the Websites, to improve our marketing activities, to enforce our Terms of Use, and prevent malicious conduct. In some cases, our third-party partners may process information collected by cookies and similar technologies on the Websites. Also, our vendors and third-party partners may use information collected through cookies and similar technologies to associate other information they or others have about you, including your email address.

The Services do not respond to browser do-not-track signals. If your browser offers you the ability to use Global Privacy Control (GPC) to communicate your privacy preferences to us, we honor such signals by opting you out of or restricting cookie technology that may otherwise constitute “sharing” for targeted advertising or a “sale” under state privacy laws. You may be able to change your web browser’s settings to block and delete cookies when you access the Services through the web browser; however, if you do so, the Services may not work properly, and, we will still receive basic information (such as last URL visited) when you navigate to the Services. Use of Your Personal Information

We use the personal information we collect from you for the following purposes:

  • To provide the Services to you.
  • To interact with you, including responding to your requests; providing customer support; providing information about additional products, services, and promotions that may be of interest to you; and informing you about important changes to this Policy, our Terms of Use, or other policies.
  • For internal review.
  • To manage, operate, and improve the Services and the content of our Websites and grow our business, including monitoring the performance of our Services; understanding our customer base and the effectiveness of our marketing, events, promotional campaigns, and publications; developing new products and services; and diagnosing or fixing technology problems.
  • To customize the content and/or layout of the Services and our communications for each individual user, including advertising.
  • To notify users about updates to the Services.
  • To comply with legal requirements and industry standards; detect, investigate, and prevent activities that may violate our policies or be fraudulent or illegal; and protect the rights of Agricen, you, or others.
  • To compile and disclose statistics about our users of our Services and their preferences.

Disclosure of Your Personal Information

We may share any of the categories of personal information listed above for our commercial and other business purposes as described below.

  • Service Providers. We may share your information with service providers that we believe need the information to perform a technology, business, or other professional function for us such as billing and collection, IT services, maintenance and hosting of our Services, payment processors, marketing partners, accounting, auditing, and tax services, and other professional services.
  • Analytics Partners. We partner with analytics providers, who collect information via tracking technologies on our Services to assist us with measuring visits and traffic on our Services so we can measure and improve the performance of the
  • Advertising Partners. We partner with third parties who assist us in serving advertising regarding the Services to those who may be interested in the Services. These third parties may use tracking technologies to collect or receive information from the Services and elsewhere on the internet and use that information to provide measurement services and target ads. Third parties may allow other companies to access information about you so that they may market other products you may be interested in.
  • Social Media Platforms. If you interact with us on social media platforms, the platform may be able to collect information about you and your interaction with us. If you interact with social media objects on our Services (for example, by clicking on a Facebook “like” button), both the platform and your connections on the platform may be able to view that activity. To control this sharing of information, please review the privacy policy of the relevant social media platform.
  • We share information with other members of Agricen or the Agricen family companies, for purposes consistent with this Policy.
  • Corporate Event. We reserve the right to transfer to another entity or its affiliates or service providers some or all information about you in connection with, or during negotiations of, any merger, acquisition, sale of assets or any line of business, change in ownership control, or financing transaction. We cannot promise that an acquiring party or the merged entity will have the same privacy practices or treat your information the same as described in this Policy.
  • We share information where necessary to comply with applicable law; to respond to requests from law enforcement agencies or other government authorities or third-parties; as permitted by law and without your consent when it is necessary to protect our customers, employees, or property; in emergency situations; or to enforce our rights under our Terms of Use and policies.

Protection of Information

We have implemented technology safeguards, security policies, and other measures to protect data under our control from unauthorized access, improper use, alteration, unlawful or accidental destruction or accidental loss. While we use these precautions to safeguard your information, we cannot guarantee the security of the networks, systems, servers, devices, and databases we operate or that are operated on our behalf.

If you use our Services outside of the United States, you understand that we may collect, process, and store your personal information in the United States and other countries.

Retention of Personal Information

We will retain your personal information for as long as is necessary to complete the purposes for which it was collected, or as may be required by law. We use the following criteria to determine the length of time for which we retain personal information subject to this Policy:

  • the purposes for which the personal information is used, and the length of time for which such information is required to achieve those purposes, including for business operations, security purposes, and legal requirements;
  • whether we are required to retain the category of personal information in order to: (i) comply with legal or contractual obligations; (ii) assert or defend against potential legal claims or as necessary to investigate theft, fraud, or other activities that are potentially (a) in violation of our policies and procedures applicable to you or (b) a violation of the law; (iii) ensure a secure online environment; and/or (iv) protect health and safety;
  • the privacy impact on the consumer of ongoing retention; and
  • the manner in which the personal information is maintained and flows through our systems and how best to manage the lifecycle of such information in light of the volume and complexity of the systems in our infrastructure and the need to maintain high integrity and availability within our systems.

Individual pieces of personal information may exist in different systems that are used for different business or legal purposes. A different maximum retention period may apply to each use case of the information. Certain individual pieces of information may also be stored in combination with other individual pieces of information, and the maximum retention period may be determined by the purpose for which that information set is used.

Marketing and Advertising Options

You may have certain choices when it comes to how we collect and use your personal information:

  • Email Marketing. If at any time you no longer wish to receive marketing communications from us, you can click the unsubscribe link at the bottom of any email.
  • Online Activity Tracking and Interest-Based Advertising. You have several options to either prevent our collection of information regarding your online activity, or prevent third parties from using such information from being used for interest-based advertisements. Privacy Rights

Certain jurisdictions have specific legal requirements and grant privacy rights with respect to personal information, and we will comply with restrictions and any requests you submit as required by applicable law. If you are a California resident, please also see the “Supplemental Privacy Notice for California Residents” section below.

Nevada residents have the right to opt out of the sale of certain pieces of their information to third parties who will license or sell their information to others. However, Agricen does not sell personal information as contemplated by Nevada law.

If you are a resident of Texas or Nebraska, you have one or more of the following rights: (1) to request additional information about our data collection, use, disclosure, and sales practices in connection with your personal information; (2) to request the specific personal information collected about you; (3) to request the deletion of the personal information we have about you, with exceptions; (4) to request a restriction on certain processing of personal information; (5) to request correction of inaccurate information; (6) to opt-out of the processing of personal information for the purpose of “profiling” in furtherance of decisions that produce legal or similarly significant effects; (7) to opt-out of the “selling” and “sharing”/“targeted advertising” of personal information as such terms are defined under U.S. state privacy laws; and (8) if we deny your request, to appeal our decision.

Please note, Agricen sells personal information and shares personal information for “targeted advertising” purposes. Agricen does not engage in profiling in furtherance of decisions that produce legal or similarly significant effects. You may also have the right to not be discriminated against for exercising your privacy rights.

You, or your authorized agent, may submit a request regarding your personal information by:

To opt out of selling or “sharing”, use the “Do Not Sell or Share Personal Information” link in the bottom of the Websites to access our cookie management tool. To help protect your privacy and maintain security, we will take steps to verify your identity before granting you access to the information. This is a security measure to ensure that personal information is not disclosed to any person who has no right to receive it. When you make a request, we may require that you provide information and follow procedures so that we can verify your identity (and the applicable jurisdiction). The verification steps we take may differ depending on your jurisdiction and the request. Where possible, we will attempt to match the information that you provide in your request to information we already have on file to verify your identity. If we are able to verify your request, we will process it; if we cannot verify your request, we may ask you for additional information to help us do so.

We will respond to your request within the time period required by applicable law. However, we may not always be able or required to comply with your request, in whole or in part, and we will notify you in that event.

This Supplemental Privacy Notice for California Residents section applies to personal information of consumers who are California residents. Please also refer to the Privacy Rights section above for a description of the rights that California residents have and how to exercise those rights.

Children’s Information

We do not knowingly or intentionally gather personal information about children. If we have inadvertently collected the personal information of a child under 16, or equivalent minimum age depending on jurisdiction, a parent or guardian of that child may contact us at privacy@agricen.com to request that we delete the information from our records or otherwise cease the use of that information.

Changes to our Privacy Policy

We may make changes to this Policy from time to time. If we decide to change this Policy, we will post the changes here and update the “Last Updated” date at the top of this Policy. If we make any material changes, we will provide notice of such changes on the Websites or in any other pertinent location where this Policy may be posted for a reasonable period of time (which we estimate will be approximately two weeks). We encourage you to review this Policy periodically, especially if you don’t visit the Websites or use our Services regularly.
